Grantham court: Curfew for banned driver

A 60-year-old man was given an electronic tag after being caught driving whilst disqualified.

Robert D’Argue Hall of Emminson Way, Great Gonerby, admitted driving whilst disqualified and driving without insurance.

Hall was stopped by police driving a Renault near his home and immediately confessed to officers he was banned from driving.

Rob Arthur, defending, told the court Hall was confused about whether the driving ban he had received less than a week previous had started.

Mr Arthur told magistrates a possible reason for the confusion could be a terrible crash Hall was involved in some years ago.

Mr Arthur said: “In 2000 the defendant and his partner were involved in a very serious road traffic collision. He spent three months in hospital and one month in a coma.

“He suffered eight fractures to his head, a split pelvis, his ankle was totally destroyed and he fractured his femur. His partner had to have both her legs amputated below the knee.”

Hall’s partner has since died.

Mr Arthur added: “The injuries may have affected how he understood the ban.”

Magistrates were told the guidelines for sentencing Hall started at a prison term.

However, chair of magistrates Mr Stewart said: “We could, from our guidelines, be sending you to prison but we don’t consider that to be suitable.”

Hall had his driving ban extended by 15 months. He was also sentenced to a two-month curfew from 7pm to 7am and must pay £85 in costs and a £60 surcharge.
