Grantham court: Fight after night of drinking vodka

A 54-year-old admitted to assault by beating after fighting with his girlfriend who was upset that he hadn’t stood up for her.

Zbigniew Ebert of George Street, Grantham, pleaded guilty to one charge of assault by beating for which he was arrested on August 13.

Prosecutor Mark Major described how on the evening before Ebert and his partner had gone to their friends’ home to get help translating some documents.

During the course of the evening two bottles of vodka were shared between the four people, and Ebert’s girlfriend became upset when a piece of gossip about her came up in conversation.

Mr Major told the court: “She wasn’t happy with the defendant failing to pay attention or stand up for her.”

On their return home the two began arguing, with Ebert calling his partner a ‘bitch’, ‘psycho slut’ and ‘whore’.

It then turned into a physical fight, with both pushing each other and the defendant using both hands to push his girlfriend by the shoulders.

Despite her running into another room, the defendant then followed her and a blow to the face caused her to fall to the floor.

The brawl continued with the woman throwing a clock at Ebert, and saying she would call the police.

Ebert then left taking cigarettes and car keys with him, and she was concerned that he would drink drive.

Going outside she saw the defendant sitting in the car, and at that point decided to call the police.

Mr Major added that following the incident she had pain to the back of her head and to the middle finger of her left hand.

Representing himself, Ebert said through a translator that he did not provoke the argument, and while he accepted that he caused injuries he said that he did not hit her with his fist. He expressed regret that it had happened.

Magistrates sentenced Ebert to a community order lasting 12 months, and ordered him to pay a victim surcharge of £60 and costs of £85.

Grantham court: Three times over limit after drink at car boot

A Grantham man pleaded guilty to driving above the alcohol limit after drinking whisky while at a car boot sale.

Paul Fendley, aged 65, of Crossgill Close, appeared before magistrates charged with driving a Citreon C5 on Harrowby Road with 108 microgrammes of alcohol in 100 millilitres of breath - more than three times over the legal limit.

Prosecutor Paul Wood told the court that Fendley was involved in a minor road accident at about 1pm on August 24, and because the other driver could smell alcohol on the defendant the police were called and the breathalyser test taken.

The high reading resulted in Fendley being taken to the police station where he said during interview that he had been at a car boot sale and because business was slow he had started drinking some whisky he had with him.

Defending himself in court, Fendley said that he had bought a half bottle of whisky on the way to the car boot sale intending to drink it afterwards, but because it was quiet and a hot day he had ended up drinking half of it.

Fendley was sentenced to a community order of 18 months with a supervision requirement, and was disqualified from driving for 24 months with the opportunity to reduce it by six months if he completes a drink driving rehabilitation course.

He must also pay prosecutions costs of £85, a victim surcharge of £60 and a penalty of £50.

Rape and sexual abuse centre to open in Grantham

$

A rape support centre will open in Grantham for victims of rape and sexual abuse.

The new centres will offer victims access to expert advice, support and counselling as well as practical help throughout the criminal justice system.

It will be funded with around £300,000 a year to offer much-needed specialist services to hundreds of victims of sexual crime in areas where previously none existed.

Staff will work with female victims who have experienced rape or sexual violence at any point in their lives. In addition to face to face counselling, there will also be support groups, female-only safe spaces and even access to counsellors through Skype.

Fay Maxted, of The Survivors Trust, said: “We are delighted that funding has been awarded to establish a new rape support centre in Grantham. At the moment Grantham and the surrounding area does not have a specialist rape support centre, meaning that traumatised and vulnerable individuals who desperately need access to support can face long journeys, long waiting lists or may not be able to find support at all.”

The news came as an announcement made today (Monday) by the Minister for Women Nicky Morgan and Victims Minister Mike Penning, who also revealed plans for a similar centre in Crawley, West Sussex.

Ms Morgan said: “I want women to know that if they ever suffer the horrific ordeal of rape or sexual assault that they will be offered all of the expert advice and support they need to rebuild their lives and put the perpetrator behind bars.

“This government committed to open 15 new support centres across the country and I am proud to say that this announcement today means we have delivered on our promise.”

Further centres are located in Reading, Avon and Somerset, Preston, Lincoln, Trafford, Northumbria, Leeds, Southend, Ipswich, Aberystwyth, Hereford, Exeter and Poole.

Funding is part of the government’s Violence Against Women and Girls Action Plan, which set out plans to increase police referrals to the Crown Prosecution Service. Thanks to the work of the police in conjunction with government, progress is being made with the volume of convictions for sexual offences excluding rape now at the highest level ever.

Action has also been taken to protect more victims through national roll-out of the domestic violence disclosure scheme, known as ‘Clare’s Law’, and nearly £40 million of funding for specialist local support services and national helplines has been ring-fenced, including more than 80 independent sexual violence advisers.

Mr Penning said: “Women who experience these devastating crimes deserve the best chance to get the help they need, and ultimately justice.

“These new centres will give more victims of rape or sexual abuse the expert help they need to recover from what is truly a horrendous experience. Victims need the best support to get their lives back on track which is why these centres are so important.”

Grantham court: Drunken behaviour at station

A charge of drunk and disorderly behaviour at Grantham railway station was proved in the absence of the defendant.

Michal Jurkiewicz, aged 38, of Harrowby Road, Grantham, did not attend court despite being notified of the hearing.

Instead magistrates found the matter proved after being told details of the incident which took place on August 2.

Prosecutor Mark Major read a statement from a staff member at the station who identified that Jurkiewicz was not fit to travel.

The defendant was leaning against the ticket office trying to say that he wanted to go to Peterborough, but his words were slurred and his eyes glazed, with the employee adding that he could smell alcohol within seven feet of Jurkiewicz.

Although they got him to leave through the main entrance, Jurkiewicz remained by the station shouting and swearing to himself, staff and members of the public.

The police were then called and found him slumped on the floor, where he appeared to be making a sit down protest, and despite efforts to calm him down Jurkiewicz continued to shout and rant as well telling them repeatedly to “f**k off”.

Mr Major added that there were ‘only so many times’ they could tell him to leave the area, and he was arrested.

Magistrates ruled that Jurkiewicz must pay a fine of £400, a victim surcharge of £65 and costs of £85.

Grantham court: Arrived in an ambulance, left in a police car

A public order offence at Grantham hospital was found proved in the defendant’s absence.

Alan Pinder, aged 65, of Vale View, Newark, was not present to answer the charge of using threatening and abusive words or behaviour at the hospital on June 26.

Mark Major, prosecuting, read testimonies from a staff nurse and a support worker who were both on duty when Pinder arrived in accident and emergency by ambulance at 12.25am.

Although paramedics reported that he had been laughing and joking in the ambulance, when he was taken to the resuscitation room he refused to stay there saying that he was claustrophobic and repeatedly that he wanted a cigarette.

After insisting for a cigarette a paramedic accompanied Pinder outside, but back inside he threatened to smoke in the cubicle.

He became abusive, sticking up two fingers and saying to the nurse ‘you think you know f**king everything’, and despite being asked by staff and the relative of a patient to stop he became louder.

Mr Major said they couldn’t reason with him and in the end he was put in a wheelchair and taken outside before being driven away in a police car.

Pinder was fined £400 and ordered to pay a £40 victim surcharge and £85 in prosecution costs by magistrates.

Grantham court: Multiple shop thefts around town

Thefts from five Grantham stores, three of which took place on the same afternoon, were admitted by a 33-year-old man.

Daniel Short of Welby Street, Grantham, was sentenced this week after pleading guilty to five counts of shoplifting.

Prosecutor Paul Wood outlined how on July 29 at about 3pm Short helped himself first to two bottles of lubricant from Boots pharmacy on St Peter’s Hill, then went to the Boots on the High Street where he took a perfume tester.

Staff reported this to police and he was traced to Wilkinsons at The Pantiles where he tried to steal an air-freshner by hiding it in his sock.

On being questioned he admitted to the thefts, but on August 4 he was again caught shoplifting, this time at Sainsbury’s.

Short was spotted taking two joints of meat and leaving the store without paying, at which point he was challenged by a police officer who was at the supermarket dealing with another matter.

The defendant ran off, leaving behind the meat and saying ‘here you can have it.’

The last charge of theft related to August 23 when Short put a T-shirt and boxer shorts into a carrier bag at Sports Direct but was caught when he set off the alarms and again ran off, leaving the items.

Rory Macmillan, defending, said that his client had no problems with alcohol but did have a long standing issue with drugs.

However he added that these thefts were committed to pay for food, after Short’s benefits were stopped and he became homeless.

Magistrates gave Short a 12 month community order with a supervision and drug rehabilitation requirement, as well as ordering him to pay £85 prosecution costs and a £60 victim surcharge.

Grantham court: Community order for dad after assault

$

A 31-year-old father has been sentenced to a community order after pleading guilty to two charges of assault by beating.

Oscar Zauls, of Walton Gardens, previously appeared in court on August 18 and entered guilty pleas to the offences.

Prosecutor Mark Major detailed how on August 1 the defendant, his partner of seven years and their young child were all making their way to Grantham library when they started arguing.

On finding the library closed the row became worse with Zauls swearing at his partner who walked away.

She then sat on a bench at Dysart Park but Zauls followed and spat in her face before slapping her around the back of the head.

She again walked away and called the police, who arrived at her home address and was told about this incident as well as Zauls grabbing and punching her the day before.

This had followed a meal which Zauls said didn’t taste good, and the police saw that his partner had bruises on her upper left elbow, left shoulder, left wrist and to the back of one leg and shin.

Rob Arthur, defending, highlighted that following this, no formal statement was actually made against Zauls, and yet he gave ‘a full and frank admission’ to police.

Referring to psychological reasons behind Zauls’ behaviour, Mr Arthur said “He had realised things had gone out of control for him on a personal level and was more than happy to accept his culpability to the domestic assault in the hope some assistance would be given to him.”

He added that Zauls’ partner had come to court both times to support him, and as he was now working to resolve his personal issues she was happy to continue the relationship.

The community order given to Zauls will last 9 months, and he was also ordered to pay prosecution costs of £85 and a victim surcharge of £60.
